AnywhereCD files a lawsuit against Warner Music
online music retailer AnywhereCD has announced that they are filing a lawsuit against the Warner Music Group. they are alleging breach of contract, business defamation and trade libel.
Warner interestingly has already filed an action asking the court to enforce their termination of contract with AnywhereCD.
The problem between the two companies started when Warner Music issued a cease and desist order asking the AnywhereCD to stop selling its artists’ albums as MP3 files.
They claimed that these were infringing upon their rights and was breaking their deal. MP3 is a DRM free format and does not allow the companies to control the usage rights of the media file.
AnywhereCD is claiming in their lawsuit that Warner Music had acted “maliciously and in bad faith.” Warner on their part said in a statement: “We regret that we were compelled to exercise our contractual rights to require the removal of our content from their site.”
